Subpoena leads to payment and additional fees

A client approached us because although her debtor promised to pay several times, the outstanding balance remained outstanding. We advised her to seize the competent court and resolve the matter through a writ of summons.

 

Before the hearing, €5,000 of the arrears had already been paid. After the verdict, the remaining balance was paid off in full, and the client was also awarded interest of 12.5% and damages of 10% of the outstanding amount. In addition, she received a litigation fee of EUR1,250, a flat fee set by the government for court proceedings. These additional fees were not included in the initial promise to pay, but were awarded thanks to the verdict, so this effectively proved to be the right choice for this client.
